User Agreement

1. Acceptance of Terms

By accessing or using the Luxury Cheaper Boutique website (fashionistaluxe.com · luxurycheaperboutique.com), or by purchasing directly through our website or from our stores on eBay, Poshmark, or Mercari, you ("Buyer" or "User") agree to be legally bound by this User Agreement ("Agreement"). This Agreement constitutes a binding contract between you and Luxury Cheaper LLC, a Florida-registered business operating as Luxury Cheaper Boutique.

If you do not agree to all terms and conditions of this Agreement, you must immediately discontinue use of our website and refrain from making any purchases through our stores. Your continued use of our services constitutes your ongoing acceptance of this Agreement as it may be updated from time to time.

2. Eligibility

You must be at least 18 years of age to use our services or make a purchase. By using our website or completing a transaction, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

If you are purchasing on behalf of a business or organization, you represent that you have the authority to bind that entity to this Agreement.

3. Authenticity Guarantee

Luxury Cheaper Boutique stands behind the authenticity of every item we sell. All designer pieces are carefully inspected prior to listing. We source our inventory through reputable channels and apply rigorous inspection standards to every item — examining hardware, stitching, date codes, dust bags, serial numbers, and other brand-specific identifiers. Many items ship with a Luxury Cheaper Boutique Authenticity Card — this card is issued by Luxury Cheaper LLC and represents our own inspection and guarantee. It is not issued by, affiliated with, or endorsed by the original designer brand.

If you believe an item you received is not authentic, please contact us at [email protected] within 30 days of confirmed delivery. Authenticity concerns raised after this 30-day window may not be eligible for a resolution. To be eligible, concerns must be supported by written documentation from a recognized third-party authentication service (such as Entrupy, Real Authentication, or a brand-authorized retailer).

We reserve the right to request the item be returned for independent inspection before issuing any resolution. Items that have been worn, altered, or damaged after receipt may not be eligible for an authenticity-based resolution. Note: our standard 15-day return window (Section 5) applies to general returns only and is separate from this Authenticity Guarantee.

4. Purchases & Payments

All purchases are subject to availability. Prices are listed in U.S. dollars and are subject to change without prior notice. Listing an item does not constitute a reservation; the sale is only confirmed upon receipt of full payment.

Purchases made directly through fashionistaluxe.com are processed securely via Stripe. Depending on the payment method selected at checkout, your transaction may also be processed by PayPal, Klarna, Afterpay, Affirm, Cash App Pay, or ACH bank transfer. In all cases, Luxury Cheaper LLC is the seller of record. We do not store your full payment card number on our servers — payment processing is handled entirely by the applicable payment processor under their own terms and privacy policy.

By completing a purchase, you confirm that: (a) you are authorized to use the payment method provided; and (b) the billing and shipping information you supply is accurate and complete.

If you experience an issue with your purchase, we encourage you to contact us first at [email protected] so we can make a good-faith effort to resolve the matter. Nothing in this Agreement limits any rights or remedies available to you under applicable law or your payment provider's rules.

5. Returns & Refunds

We accept eligible returns requested within 15 days of confirmed delivery. To initiate a return, you must contact us at [email protected] within this window with your order number and reason for return. Returns requested after 15 days will not be accepted.

Returned merchandise must be in the same condition in which it was received — unused and unworn, with all original tags, security/authenticity tags, accessories, authenticity materials, and original packaging included when applicable. Items showing signs of use, alteration, damage after delivery, or removal or alteration of security/authenticity tags may not qualify for a return.

Unless the item received was incorrect, damaged upon arrival, or materially not as described, the customer is responsible for return shipping costs. For returns due to our error, we will provide a prepaid return shipping label. Approved refunds will be issued to the original payment method after the returned merchandise has been received and inspected.

Final sale items, as clearly marked at the time of listing, are not eligible for return or refund.

6. Shipping & Delivery

Orders are typically processed and shipped within 1–2 business days of payment confirmation. Domestic shipments are sent via USPS, UPS, or FedEx with full tracking. International shipments are sent via DHL or USPS Priority Mail International.

Delivery timelines are estimates and are not guaranteed. Luxury Cheaper Boutique is not responsible for delays caused by the carrier, weather events, customs processing, or other circumstances beyond our control.

International buyers are solely responsible for any customs fees, import duties, or taxes imposed by their country. These charges are not included in the item price or shipping cost.

We are committed to ensuring your order arrives safely. If your order is lost in transit or arrives damaged, please contact us at [email protected] as soon as possible with your order number and, where applicable, photographic evidence of the damage. We will work with you and the carrier to resolve the issue. Carrier delays or service disruptions outside our control are not guaranteed against, but we will do our best to assist.

7. Intellectual Property

All content on fashionistaluxe.com — including but not limited to text, photographs, graphics, logos, and design — is the property of Luxury Cheaper LLC or its content suppliers and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or commercially exploit any content from this website without our express prior written consent. Unauthorized use of our content may give rise to a claim for damages and/or be a criminal offense.

The designer brand names, logos, and trademarks referenced on this site (Louis Vuitton, Chanel, Hermès, Gucci, Prada, Dior, Burberry, YSL, Coach, Tiffany & Co., and others) are the property of their respective owners. Their use on this site is solely for the purpose of accurately describing the pre-owned items we sell and does not imply any affiliation with or endorsement by those brands.

8. Prohibited Conduct

You agree not to use our website or services to:

9. Disclaimer of Warranties

To the fullest extent permitted by law, Luxury Cheaper Boutique disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information on our website.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Luxury Cheaper LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of our website or services, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising from or related to a purchase shall not exceed the purchase price paid for the specific item giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

We sell directly through fashionistaluxe.com and luxurycheaperboutique.com. We may also maintain storefronts on third-party marketplaces such as eBay, Poshmark, and Mercari; transactions completed through those platforms are subject to the respective platform's terms of service, buyer protection policies, and privacy policies.

We are not responsible for the content, policies, or practices of any third-party websites linked from our site. Links to third-party sites are provided for convenience only and do not constitute an endorsement.

13. Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

14. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to this Agreement or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Before initiating any formal legal proceeding, you agree to first contact us at [email protected] and make a good-faith effort to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving written notice.

15. Changes to This Agreement

We reserve the right to modify this User Agreement at any time at our sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of our website or services after any changes are posted constitutes your acceptance of the revised Agreement.

We are not affiliated with, associated with, sponsored by, endorsed by, or an authorized retailer of Louis Vuitton, Chanel, Gucci, Hermès, Prada, Christian Dior, Fendi, Burberry, YSL (Saint Laurent), Coach, Tiffany & Co., Valentino, Givenchy, or any other designer brands featured on this website.
